These Terms and Conditions apply to the website, courses, tutoring, digital resources, physical products and other services supplied by Aviation Theory Australia.
By purchasing or enrolling in a product or service from Aviation Theory Australia, you agree to these Terms and Conditions.
Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
“Aviation Theory Australia”, “ATA”, “we”, “us” and “our” refer to Aviation Theory Australia.
“You”, “your”, “student” and “customer” refer to the person purchasing, accessing or receiving a product or service from ATA.

ATA provides aviation theory education, online courses, tutoring, educational resources and associated aviation products.
ATA may offer:
The inclusions, dates, duration, access period and price applicable to a particular product or service are those displayed on the relevant product or course page or otherwise confirmed by ATA at the time of purchase.
Where there is an inconsistency between a general statement on our website and the specific written inclusions provided for a particular course or product, the specific course or product information will apply.
A place in a live course is not secured until any required payment or deposit has been received and ATA has accepted the enrolment.
Live courses may have limited places.
ATA may close enrolments once a course reaches capacity.
Where a student enrols through a flight school, employer or other organisation, these Terms continue to apply to the student's participation in the course unless another written agreement applies.
Live-course dates and planned session times will be published on the relevant course page, timetable or enrolment information.
Students are responsible for reviewing the timetable and determining whether they can reasonably attend the course before enrolling.
ATA may make reasonable changes to:
Where practicable, students will be given reasonable notice of changes.
ATA will not materially reduce the overall service purchased without providing an appropriate alternative or remedy.
Students are responsible for attending scheduled live sessions.
A student's inability to attend a session does not, by itself, mean that ATA has failed to provide the service where the session was made available as scheduled.
Unless expressly stated otherwise for a particular course:
ATA may, at its discretion, provide additional support, alternative materials or catch-up assistance where reasonably practicable.
Any additional one-to-one tutoring requested because of missed classes may be charged separately unless ATA agrees otherwise.
Some live courses include prescribed preparation, self-study, quizzes, practice examinations or other work between sessions.
Students are responsible for completing reasonable preparation and revision necessary to participate effectively in the course.
ATA cannot guarantee a particular academic or examination outcome where a student:
Students are responsible for having access to:
ATA is not responsible for a student's local internet failure, device malfunction or other technical problem outside ATA's reasonable control.
If a technical problem attributable to ATA materially prevents delivery of a live session, ATA will take reasonable steps to provide the affected teaching through a rescheduled session, alternative delivery or another appropriate remedy.
The materials included in a live course vary between products.
A course may include combinations of:
Only materials expressly stated to be included in the relevant course package are included in the course price.
Where physical materials need to be ordered or dispatched before a live course, ATA may do so in advance of the course commencing.
Some live courses include access to ATA's self-paced learning platform.

Students must behave reasonably and respectfully during live courses and when using ATA discussion boards, online platforms and student-support channels.
ATA may take reasonable action where a student:
Where reasonably practicable, ATA will first raise the issue with the student and provide an opportunity to address the behaviour.
For serious or repeated misconduct, ATA may restrict participation or terminate access where reasonably necessary.
Students should check course dates, availability and suitability carefully before enrolling.
ATA is not generally required to provide a refund merely because a student:
This does not affect any rights the student may have under the Australian Consumer Law.
If you need to cancel an enrolment, contact ATA as early as possible.
Where a cancellation is made sufficiently in advance, ATA will endeavour to provide a reasonable outcome, which may include:
Any amount retained because of a student cancellation will be limited to ATA's reasonable costs and losses associated with the cancelled enrolment. These may include reasonable administrative costs, non-refundable payment costs, physical materials already ordered or supplied, and reasonable costs associated with reserving a limited course place.
ATA will not impose a cancellation charge merely as a penalty.
A request to move to another course or intake should be made as early as possible.
Transfers are subject to:
Where reasonable, ATA will generally prefer a transfer or credit over losing a student's course fees entirely.
A transfer is not guaranteed where the request is made after substantial delivery of the original course.
Once a live course has commenced, students are not automatically entitled to a refund simply because they choose not to continue.

Nothing in this section limits a student's rights where the service does not meet a consumer guarantee.
ATA understands that genuine circumstances can arise unexpectedly.
Students experiencing serious or exceptional circumstances are encouraged to contact ATA.

Any such arrangement is assessed individually and does not create an automatic entitlement in other circumstances.
ATA may occasionally need to alter, postpone or cancel a live course or individual session because of circumstances such as:
Where possible, ATA will first attempt to provide the service by:
If ATA cancels a course and cannot provide a reasonable equivalent alternative, students will be entitled to an appropriate refund for the part of the service that has not been supplied.
ATA will not require a student to accept a materially different service in place of the service purchased.
Access to self-paced courses is provided for the period stated at the time of purchase.
Course access is personal to the student and must not be:
Aviation legislation, examination requirements and operational information can change.
ATA may update or replace course material during a student's access period to maintain accuracy or improve the course.
Students should use the most current version of the material available through the platform.
Students should review course descriptions carefully before purchasing.
A change of mind after accessing a digital course does not automatically entitle the purchaser to a refund.
This does not affect rights under the Australian Consumer Law if the digital product or service fails to meet an applicable consumer guarantee.
Tutoring appointments are subject to instructor availability.
Students should provide as much notice as reasonably possible if they need to reschedule or cancel an appointment.
Where a student misses an agreed tutoring appointment or cancels with insufficient notice, ATA may charge a reasonable cancellation amount reflecting the time reserved and costs incurred.
ATA may waive or reduce such charges where appropriate.
Tutoring is intended to assist understanding and examination preparation but does not guarantee a particular CASA examination result.
All prices are displayed in Australian dollars unless otherwise stated.
Any taxes required by law will be included or clearly disclosed as applicable.
The price payable is the price agreed at the time the order or enrolment is accepted.
ATA may change future prices at any time, but a later price change will not retrospectively alter the agreed price of an existing fully accepted purchase.
Payment may be required:
Students remain responsible for completing agreed payments when due.
Where ATA allows a student to secure a limited live-course place by paying a deposit, the deposit forms part of the overall course fee.
A deposit should not be treated as automatically forfeited in every circumstance.
If the student later cancels, ATA may apply part or all of the deposit toward reasonable cancellation costs or losses. Any treatment of the deposit remains subject to applicable consumer law.
Physical products must match their description and satisfy applicable consumer guarantees.
If an item is faulty, damaged, incorrectly supplied or otherwise fails to meet an applicable consumer guarantee, contact ATA so that an appropriate remedy can be provided.
For change-of-mind returns of physical goods, ATA may impose separate conditions provided those conditions do not restrict rights under the Australian Consumer Law.
ATA is not required to provide a change-of-mind refund merely because a customer no longer wants an otherwise satisfactory product.
Where physical products are shipped:
ATA will take reasonable steps to resolve significant delivery problems associated with an order.

ATA will take reasonable care to provide accurate and current educational material but students should always follow current legislation, official publications and examination instructions where these differ from older study material.
Aviation Theory Australia provides educational material for aviation theory study and examination preparation.
While ATA takes reasonable care to maintain accurate and current content, aviation legislation, procedures, publications, examination requirements and other information may change.
ATA course material is intended as a study aid and does not replace current legislation, CASA publications, aircraft documentation, operational procedures, flight-school instructions or professional aviation judgement.
Students and pilots remain responsible for confirming that information used for an examination, flight or operational purpose is current and applicable.
Where there is any inconsistency between ATA educational material and an applicable current law, regulation, official publication, aircraft document or authorised operational procedure, the authoritative source takes precedence.
Statements about previous student results, testimonials or course outcomes are not guarantees that another student will achieve the same result.
Performance may depend on matters including:
ATA's obligation is to provide the purchased educational service with the care and skill required by law, not to guarantee an examination result.
Services supplied to consumers are subject to statutory guarantees including due care and skill, fitness for disclosed purpose where applicable, and supply within a reasonable time where no time has otherwise been agreed.
ATA may use third-party providers for:
Reasonable interruptions to a third-party platform may occasionally occur.
ATA will take reasonable steps to restore access or provide an alternative where a material interruption substantially affects a service purchased from ATA.
Unless otherwise stated, ATA owns or is licensed to use the intellectual property in its original:
Purchasing a course gives the student a personal, limited right to use the supplied material for their own study.
Students must not, without written permission:
Third-party books, publications, charts and other materials remain subject to the rights of their respective owners.
The absence of a copyright notice on an individual ATA resource does not waive or surrender any copyright or intellectual-property rights in that material.
Students must not record, photograph, screen-record or otherwise reproduce a live class without ATA's prior permission.

ATA will advise students if ATA itself intends to record a particular class.
Unless expressly advertised as an inclusion, students should assume that live classes will not be provided as recordings.
Students are responsible for maintaining the security of their account details.
Accounts are intended for one authorised user unless ATA has expressly agreed otherwise.
ATA may reasonably suspend access where it believes:
ATA will ordinarily give the student an opportunity to resolve the issue where reasonable.
Our products and services come with rights and guarantees that cannot be excluded under the Australian Consumer Law where it applies.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify those rights.
Consumer guarantees apply automatically to covered products and services, and a business's own returns or refund policy operates in addition to, rather than instead of, those statutory rights.

Examples may include significant internet or infrastructure outages, natural disasters, government restrictions, emergencies or other events that make scheduled delivery impracticable.
